01About these terms
These terms apply when you use this website and when you buy services from Fred Smith, trading as Avyren (“Avyren”, “we”, “us”). Please read them before you order. By asking us to start work, you agree to them.

02Our services
- Website: custom website design and build, then ongoing hosting and maintenance.
- AI missed-call agent: an automated WhatsApp assistant that replies to your missed calls, with ongoing hosting.
- Package: both services together.
03The free demo
We can build a free demo before you commit. There is no obligation to buy. The demo stays our property until you order, and we may reuse its design elements if you decide not to go ahead.
04Prices and payment
Current prices are shown on our pricing page. Each service has a one-off setup fee and a monthly fee for hosting and maintenance. We are not VAT registered, so no VAT is added.
The setup fee is due before your service goes live. Monthly fees are paid in advance. If a payment is more than 14 days late, we may pause the service until it is paid.
05Minimum term and cancelling
Monthly plans have a 3-month minimum term from the date your service goes live. After that, either of us can end the plan by giving one month’s notice by email.
If you are a consumer (buying for yourself, not for a business), you have 14 days from the day you order to cancel for any reason. If you ask us to start work within those 14 days, you will pay for work we have done up to the point you cancel. This does not affect your other legal rights.
06Your content and responsibilities
You are responsible for the text, images, logos and other material you give us, and you confirm you have the right to use it. You give us permission to use that material to build and run your services.
You are responsible for making sure your own website and messages comply with the laws that apply to your business.
07Who owns what
Once you have paid the setup fee, you own the content and design created specifically for your website. We keep ownership of our own tools, code, templates and know-how, and you have a licence to use them as part of your website while your plan is active.
We may show your finished website in our portfolio. Just tell us if you’d prefer we didn’t.
08The AI missed-call agent
The agent sends automated replies using AI. It is designed to be accurate but can make mistakes, so please review its set-up and replies, and don’t rely on it for emergencies or anything safety-critical.
The agent runs on WhatsApp, so it also depends on Meta’s WhatsApp Business terms and availability, which are outside our control.
09Data processing for your customers
When we run the AI agent or your website, we may handle personal data about your customers. You are the controller of that data and we are your processor. We will:
- only use it to provide the services and follow your documented instructions;
- keep it confidential and protected with appropriate security;
- only use sub-processors such as hosting, AI and WhatsApp providers under written terms that protect the data, and tell you about any changes;
- help you respond to requests from your customers and meet your legal obligations;
- tell you without undue delay if we become aware of a data breach;
- delete or return the data when our services end, unless the law requires us to keep it; and
- give you the information you need to show these terms are being met.
10Our liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot legally be limited.
If you are a business, we are not liable for loss of profits, sales, business or data, or for indirect losses. Our total liability to you is limited to the fees you paid us in the 12 months before the claim.
If you are a consumer, we are responsible for losses you suffer that are a foreseeable result of us breaking these terms or failing to use reasonable care and skill.
11Using this website
We try to keep this website accurate, but its content is general information and may change. The AI Website Advisor’s recommendations are a helpful guide, not a quote. We are not responsible for the content of websites we link to.
12Governing law
These terms are governed by the law of England and Wales, and disputes will be dealt with by its courts. If you are a consumer living in Scotland or Northern Ireland, you can also bring proceedings there.
